Acceptance of Terms
By accessing, registering, or using the Elite Pro typing software ("Platform"), provided by Silverwink IT Training Institute ("Institute", "We", "Our", "Us"), you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions, you must immediately cease all use of the Platform.
Provision of Service & Data Loss
The Elite Pro platform is provided as an educational tool. We maintain full authority over the administration of the software.
- We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice.
- Data Purging: User scores and custom uploaded `.txt` files are stored locally via JSON. We reserve the absolute right to delete, purge, or overwrite this data at our sole discretion for server maintenance or any other reason, without any obligation to provide data recovery or backups.
User Responsibilities & Uploaded Content
Students are permitted to upload custom `.txt` files for typing practice. By utilizing this feature, you expressly agree that:
- You bear sole legal responsibility for the content you upload. You shall not upload proprietary, illegal, offensive, or copyrighted materials belonging to third parties.
- The Institute accepts zero liability for any unauthorized or copyrighted content uploaded by users. We act merely as a passive conduit for your educational practice.
- We reserve the right to review and permanently delete any user-uploaded files at our discretion, without warning or explanation.
Disclaimer of Warranties
Crucial Clause
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SILVERWINK IT TRAINING INSTITUTE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT TYPING METRICS (WPM, ACCURACY) WILL DIRECTLY TRANSLATE TO SUCCESS IN GOVERNMENT, PRIVATE, OR COMPETITIVE EXAMINATIONS.
Limitation of Liability
To the maximum extent permitted by applicable law, Silverwink IT Training Institute, its owners, directors, and developers shall NOT BE LIABLE for any direct, indirect, incidental, special, or consequential damages resulting from your use or inability to use the Platform. This includes, but is not limited to, failure in typing examinations, loss of employment opportunities, data loss, or server interruptions. Your sole remedy for dissatisfaction with the software is to stop using it.
Intellectual Property & Account Termination
All source code, platform design, UI/UX, and default chapter content belong exclusively to Silverwink IT Training Institute. You may not copy, reverse-engineer, or distribute any part of this software.
Termination: We reserve the right to suspend or permanently terminate your account and block your access to the Platform at our sole and absolute discretion, immediately and without notice, if we believe you have violated these Terms or pose a risk to the Platform.
Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes, claims, or legal proceedings arising out of or relating to the use of this Platform shall be subject to the exclusive jurisdiction of the competent courts located in Muzaffarnagar, Uttar Pradesh, India.
